Owner and Subcontractor Fined after the
Death of a Worker
The former owner of a housing complex for
seniors that was undergoing construction was fined $160,000, and the director
of a subcontracted firm was fined $10,000 after the death of a worker.
In December of 2004, a worker was moving
from a partially-built steel roof on a two-storey structure on an elevated work
platform (a zoom-boom manlift) that was beside the structure. While descending
from the roof to the work platform, the worker slipped or lost balance and fell
approximately 12.2 metres (40 feet) to the ground, landing between the wheels
of the elevated work platform. The worker was dead upon arrive at a Mississauga, Ont.
hospital.
The Ministry of Labour investigation found
that the worker was not wearing any fall arrest equipment.
The owner at the time of the incident
pleaded guilty, as a constructor, to failing to ensure that the worker was
protected by a fall arrest system, as required by Section 26.1(2) of the
Construction Regulation. The director of the subcontractor also pleaded guilty
to failing to ensure that the worker was protected by a fall arrest system.
