Ontario Construction Secretariat - Third Quarter Economic Update
Recently updated data show that Ontario’s economy is currently experiencing the weakest growth in the country. The Ontario Construction Secretariat (OCS) consensus forecast, based on the most recent financial institution forecasts, shows a sharp downgrade to the economic growth outlook over the rest of 2006 and into 2007 compared to forecasts at the beginning of 2006. The Supreme Court of Canada’s 1999 decision in M.J.B. Enterprises Ltd. v. Defence Construction (1951) Ltd., [1999] 1 S.C.R. 619, [1999] S.C.J. No. 17 is an important case for both contractors and owners. Since that decision, however, the courts are still trying to come to grips with the issue of errors in the bid and whether they are fatal “non-compliance,” or mere technicalities capable of being “corrected” (or ignored).
